As far as the 9/11 trials go, when it doesn’t support his view, Bill O’Reilly doesn’t care about the Constitution. At least, that’s what he told Fox News‘ Judge Andrew Napolitano. In response to Napolitano’s accurate assertion that the Constitution provides the right to be tried in the location where the crime was committed, O’Reilly stated, “I don’t care about the Constitution!”
O’REILLY: So why is he entitled to come to New York City to be tried in the civilian criminal court if he’s arrested in Pakistan?
NAPOLITANO: Because the document you don’t want me to talk about says when the government is going to prosecute you, it must do so in the place where the alleged harm was caused.
Here is Article 3, Section 2 of the United States Constitution:
The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed.
